Today, marital agreements are becoming the mainstream for couples of all income groups. They are no longer just for the rich. Prenups are becoming more common in every age group and income group. Millennials are particularly excited about prenups. These agreements are seen as a way to reduce the trauma and cost of a possible divorce. In most jurisdictions in the United States, five elements are required for a valid matrimonial agreement:[38] Goa is the only Indian state in which a marriage book is legally applicable, since it follows the Portuguese Civil Code of 1867. At the time of marriage, a marital agreement indicating the ownership regime may be signed between the two parties. If a non-spouse has not been signed, the marital property is simply divided equally between the man and the woman. [9] [10] Ketubah is a Hebrew marriage contract that dates back more than 2000 years and was one of the first legal documents to grant women legality and finance. Later, in 7th-century writings, narrated in „Marriage in Early Ireland,“ dowry was considered an early form of marital agreement deemed necessary for marriages. In the past, Prenups protected the party with the most money, which was often man, fuelling resentment and fear within marriage. However, the number of couples signing a premarital contract before tying the knot has skyrocketed in recent years. Today, the stigma of entering a prenup is an ancient story, thanks in part to the many same-sex couples, women and millennials who have regarded the idea of a prenupe as a smart business/life train. After that date, marital agreements focus less on ensuring that married women have at least something if their husbands were to die or leave to ensure that women can protect their property and inheritance from their husbands.
