It also protects your customer if they are forced to violate this transport service contract for reasons that are beyond their control. 4.1 The consignor or his duly authorised agents shall offer to the carrier, during the term of this Agreement (number), shipments of products from the principal place and, if circumstances so require due to the special needs of the shipper, as well as part of the shipments from the secondary sites. Notwithstanding the foregoing, the carrier understands that no shipment can be offered to it from the secondary sites. The shipper shall provide other information reasonably required of the carrier in order to enable the carrier to provide services and perform its obligations under this contract. The price index is an annual exercise to adjust logistics tariffs by a price index in order to maintain the value of the contract in line with inflation and price volatility at the market level. By affixing their respective electronic signatures below, the parties agree to conclude, enforce and maintain the entire transport service contract for the agreed period. Shipping sites or other authorized representatives shall draw up a bill of lading for each consignment and the conditions shall be included therefly, unless such conditions are contrary to the provisions of this Agreement. In the event of such a conflict, priority will be given to the terms of this agreement. The carrier retains bills of lading and delivery notes for a period of at least four (4) years.

3.6 If, during the term of this Agreement, the Shipper changes its location by adding a warehouse (the „New Site“) to the list in the Appendix (List Letter), the Shipper may first assign the new site to the Carrier for a maximum period of six (6) months, at the rates proposed by the Carrier, calculated on the same economic basis as the Agreed Rates. During this six (6) month period, the shipper requests price proposals for transportation and shipping services to and from the new site from the carrier and other external transportation providers. At the end of this offer process and at the sole discretion of the shipper, the shipper may assign the new site transport services to a carrier considered by the shipper to be the most suitable. . . .
