We do not find the 1968 agreement as clear as the first instance. Part of Confederation in 1968 was that in addition to clearing, paving and damming the roadway, the municipality would remove and replace shady trees along the Avon Highway. It is certainly possible, even if it is not clear from the agreement itself, that the removal and replacement of trees does not work on the pavement itself, but on the land adjacent to the road. With this provision in mind, the importance of „the obligation for the owner of the property to carry out future repairs“ becomes less certain.
